This Terms and Conditions document governs the use of The ToolShed Web Store Service. This Agreement can be accessed at any time from the footer of any page of the website.
Terms of Trade
The ToolShed owns and operates this website www.thetoolshed.co.nz, and is located in New Zealand. Contact details for each individual store can be found by clicking here.
Acceptance of Terms
When you access this site, you acknowledge that you have read and agree to the terms described below. If you do not agree to the terms discussed here, you should exit the site and refrain from placing any order.
Contract, Payment and Delivery
Orders will be accepted by The ToolShed, for delivery in New Zealand only. Payment is to be made in NZ currency. Any contract arising from this site is governed by the laws of New Zealand.
Product specifications may vary from what is advertised.
Products may be added to or removed from the website from time to time. While we do not accept liability for any loss arising, every effort will be made to keep the information up to date and accurate.
Products marked as 'in stock' on the website may not be available in all stores but can be ordered from their respective supplier.
All prices in the shopping areas are in New Zealand dollars (NZ$) and include GST (15% sales tax). Prices may increase or decrease from time to time. Prices shown at the time of purchase are the prices you will pay. You must pay by Mastercard or Visa. We will not accept cheques or cash on delivery. The ToolShed takes no responsibility for pricing mistakes etc.
All products are priced at 'trade price' known as 'Retail Trade Price' (RTP). GoodMates receive a further discount on selected items (See GoodMates).
Any discounts from retail pricing are based on savings from The ToolShed's Trade Retail Price.
Any 'cost +' promotions are based on our dealer net prices and excludes any other negotiations and standard terms and conditions with suppliers.
Any redemptions are not in conjuntion with any other offers
Products displayed on The ToolShed shopping site can be purchased using secure online Mastercard and Visa transaction facility.
We also accept our gifcards and Laybuy online.
The ToolShed reserves the right to abort a sale at any point.
The ToolShed are associated with DPS, New Zealandʼs largest and most preferred payment gateway provider.
The ToolShed do not collect or store any credit card information. This information is all processed by DPS. When making a purchase you will be directed to a secure webpage hosted by DPS to enter your payment details.
We only accept gift cards and Laybuy online. Afterpay, Genoapay and Finance Now can only be processed in store currently
You cannot order online from our Pacific partner stores and not all products are available in store.
All payments made by puchase order (Charge accounts) are subject to individual approval.
You will be asked to register as a member of The ToolShed. Apart from the many member benefits, including receiving regular emails containing special deals, your shopping address details will be filed saving you the effort of entering these details each time you go to the checkout.
As a registered customer we will send you emails and updates from time to time to inform you of new ranges, special offers and discounts. Please note, you are able to unsubscribe from our email updates at any time.
Registering also joins you up to our GoodMates club.
Milwaukee MX FUEL Purchases
The customer consents to The ToolShed registering the customer's purchases on the Milwaukee MX FUEL online portal and agrees to being contacted by the Milwaukee JSS team.
GoodMates are eligible for a 10% discount on selected products. This generally includes all hand-tools, accessories (excluding storage) and consumables. It does not apply to products that are discounted, on special or sold in sets.
The ToolShed also reserves the right to decide which products are eligible for the GoodMates discount.
Milwaukee MX FUEL accessories are not eligible for the GoodMates discount
You cannot cancel your order once it has been placed. Please contact your dispatch store as soon as possible if you need to make changes to your order.
We use the secure Hosted Payment page solution from DP to process online orders. Customers can see their cards being authorized and debited in real time, all in an SSL (Secure Socket Layer) environment. DP is committed to protecting the security of your data.
We will not deliver to a Post Office box or any address in which we deem suspicious. We ship our goods using PBT.
Generally, products are dispatched the next working day but may take up to 14 days to be delivered. Please contact us if you have not received your product within this time.
We will notify you if your product cannot be dispatched.
Delivery charges will be added to each order and shown as a separate item before you chose to enter your payment details and send the order to be processed within New Zealand.
Should your order incur an additional charge, we will advise you prior to processing your order.
Should you feel that your goods do not arrive in good condition, please feel free to contact us.
We are not responsible for loss or damage of goods that are delivered to an incorrect address.
Many products require some assembly.
The ToolShed has flat rate shipping of $10 to non-rural addresses even if you buy large bulky items!
RD charges are calculated as follows:
0-4.9 Kg $10
5-9.9 Kg $15
10-19.9 Kg $20
20-29.9 Kg $30
30-49.9 Kg $45
50-99.9 Kg $65
100+ kg $85
The above prices are not applicable to all products and are subject to change on individual items.
Additional freight is added for further outlying islands eg. Waiheke, Stewart Island etc. You may be contacted after your payment has been received for extra freight payments.
Title and Risk
Goods are at our risk until delivered to the address given for your purchase.
Returns and Refunds
Please choose carefully as we do not refund if you change your mind. If you discover any defect with your product, you may return the item you purchased in new condition for repair or replacement within 30 days of delivery. For faulty products we may, at our discretion, repair the product or provide a complete refund. We will notify you via e-mail of the status of the replacement, repair or refund once we have received and processed the returned item. You can expect a refund in the same form of payment originally used for purchase within 7 business days of our receiving your return.
Freight will be refunded where the product is faulty or arrived damaged.
DeWalt Tools NZ offer a 30 day right of return on their brand tools.
When choosing our collection, the best of care goes into sourcing suitable pieces for you to enjoy for a reasonable amount of time.
Under our guarantee, faulty items that meet our conditions of care and use will be repaired, replaced or a refund will be issued at The ToolShedʼs discretion.
The ToolShed will repair or replace any goods which fail to comply with Consumer Guarantees Act 1993.
Where the provisions of the Consumer Guarantees Act 1993 apply, these terms will be read subject to the application of that Act, and in the case of any conflict, the provisions of that Act will apply.
Our warranties cover manufacturing defects, please note that the guarantee does not cover faults arising from:
- Normal wear and tear
- Accidental damage or mistreatment
For any claim to be made the item must be sent directly to the purchasing store. Contact details for each of our stores can be found by clicking here.
Warranty does not cover indirect or consequential damage resulting from the defects or inaccuracy or inoperativeness of the product.
All warranties for other brands supplied by The ToolShed are the responsibility of the New Zealand importer.
Warranties for Makita, Hitachi, DeWalt and Milwaukee are only valid if the tool is registered with the New Zealand importer.
Warranties shall not apply if products are bought for use by a hire company.
Limitation of Liability
The ToolShed are not liable for any direct, indirect, special, incidental or consequential damages or loss of profit arising out of the use, or the inability to use, the products on this site. This includes but is not limited to the loss of data or loss of profit, even if The ToolShed was advised of the possibility of such damages.
